This one isn’t one of them. What we’re about to tell you is the true story of one undocumented alien’s experiences with the corruption within our legal system. We hope after hearing his story, you’ll know enough to be very careful when you are looking for the right immigration lawyer. While most immigration lawyers are upright people, there are some real crooks amongst their ranks, too.</p>
<p>Pedro (that’s not his real name; you didn’t really think we were crazy enough to put his real name out there, did you?) came to the United States like many Mexican citizens. He simply crossed the Rio   Grande. Admittedly, he didn’t ask permission before he came. Frankly, the US government, while not really doing much to actually stop illegal immigration, makes it terribly difficult for people, especially Mexicans, to immigrate (or even visit) legally.</p>
<p>Pedro had no intention of staying in the United   States permanently. In fact, his original intention was only to visit his relatives, who are legal immigrants in the Northern United States.</p>
<p>While in the United States, Pedro met a girl. Yeah, we know, it’s kind of cheesy, but it happened. Pedro and this young lady became quite an item, and she became pregnant with Pedro’s baby.</p>
<p>Pedro found a job as a cook in a Chinese restaurant and has worked hard his entire time in the United States. The owner of the restaurant, a Vietnamese immigrant himself, taught Pedro to speak English. If you’ve never heard a Mexican who <a href="http://esl.about.com/">learned to speak English</a> from an Asian person, you really should find one and listen for a while, it’s one of the funniest things you’ll ever hear.</p>
<p>The restaurant owner recommended a couple of immigration lawyers to Pedro, and Pedro went about trying to become a legal US resident. He’s not an undue burden on our welfare system. He just wants to work and better himself like the rest of us do, and to be a husband to his wife and a father to his children.</p>
<p>Unfortunately, the lawyer took him for $5,000 (it had taken him a year to save the money) and has done nothing with his case. She knows that he can’t take any action against her for fear of being deported and separated from his family. His options are limited. He can either:</p>
<ul>
<li>Continue to live here illegally and      forget the money he gave the lawyer.</li>
<li>Save up to hire another lawyer, hoping      he doesn’t get screwed again.</li>
<li>Go back to Mexico and try to immigrate      legally, which could take a long time and cost him his job.</li>
</ul>
<p>We say all that to say this: be careful which <a href="http://www.immigrationlawyers.net/a-nation-of-immigrants/">immigration lawyers</a> you use. We don’t want to see the same thing happen to you. Make sure any immigration lawyer you use comes well recommended by asking to speak with several clients he has helped.</p>

Housekeeper Nicky Diaz Santillan’s attorney Gloria Allred claims that Whitman was aware of Santillan&#8217;s status as an illegal immigrant and that she fired the housekeeper after the woman asked for help.</p>
<p>Whitman maintains that she <strong>knew nothing of Santillan’s status as an illegal immigrant</strong>, but does admit to firing the housekeeper in 2009, after Santillan revealed her secret.</p>
<p>&#8220;After 9 years of faithful service, Nicky came to us in June 2009 and confessed that she was an illegal worker,&#8221; Whitman said in a statement. &#8220;Nicky had falsified the <a href="http://blogs.sacbee.com/capitolalertlatest/Diaz%20Forms.pdf">hiring documents and personal information</a> she provided to the employment agency that brought her to us in 2000. Nicky told me that she was admitting her deception now because she was <strong>aware that her lie might come out during the campaign</strong>. Nicky said she was concerned about hurting my family and me.&#8221;</p>
<p>Allred claims her client was &#8220;<strong>exploited, disrespected, humiliated and emotionally and financially abused</strong>&#8221; and says Santillan plans to file suit over unpaid wages.</p>
<p>According to Allred, &#8220;when Nicky indicated to Ms. Whitman in March 2005, that she needed to take a medical leave of absence for pregnancy, she alleges that she was told that unless she herself obtained someone to replace her, that <strong>her job might not be there</strong> for her when she returned.&#8221;</p>
<p>Exploitation of immigrant workers is a <a href="http://www.vachss.com/help_text/exploitation.html">real and growing problem</a> in the U.S., but <strong>no one can say for certain who is telling the truth</strong> in this case. Santillan claims that Whitman had to have known about her undocumented status because the Social Security Administration sent repeated letters notifying her employer that the Social Security Number Santillan provided at the time of her hiring did not match records. Whitman maintains she never saw the letters, and indicates that Santillan was responsible for bringing in the mail.</p>
<p>Federal laws provide <a href="http://www.justice.gov/crt/crim/statutes.php">stiff penalties</a> for anyone who forces others to work in servitude, and the government may be able to <strong>protect immigrant workers</strong> who have been exploited. <a href="http://www.immigrationlawyers.net/">Immigration lawyers</a> should be the first point of contact for any undocumented worker in need of assistance. The information you give to an attorney will not be used to turn you in or have you deported because of the <a href="http://legal-dictionary.thefreedictionary.com/attorney-client+privilege">attorney-client privilege</a>.</p>

<p><a href="http://www.immigrationlawyers.net/wp-content/uploads/2010/10/lou_dobbs.jpg"><img class="alignleft size-medium wp-image-127" title="lou_dobbs" src="http://www.immigrationlawyers.net/wp-content/uploads/2010/10/lou_dobbs-300x225.jpg" alt="" width="300" height="225" /></a>It has been almost a year since Lou Dobbs <a href="http://articles.cnn.com/2009-11-11/us/lou.dobbs.leaving_1_anchor-lou-dobbs-dobbs-wife-moneyline?_s=PM:US">left CNN</a> amidst a Latino protest campaign citing his inflammatory rhetoric against undocumented immigrants. Perhaps in a kind of sick twist of fate or a simple sign of the times, Dobbs himself is now accused of employing undocumented workers, something he has denied knowingly doing.</p>
<p>The Nation magazine along with the <strong>Investigative Fund at The Nation Institute</strong> ran an <a href="http://www.thenation.com/article/155209/lou-dobbs-american-hypocrite">article</a> last week after a yearlong investigation into Dobbs’ private life. They assert that he “has relied for years on undocumented labor for the upkeep of his multimillion-dollar estates and the horses he keeps for his 22-year-old daughter, Hillary, a champion show jumper.”</p>
<p>No one has claimed that Dobbs knowingly employed illegal workers, but many suggest that he could have taken steps to prevent this type of situation. Dobbs denies any knowledge that the workers were here illegally, telling ABC’s Good Morning America, &#8220;I never, ever used a contractor as a way in which to indirectly hire an illegal immigrant purposefully. Never, never, never.&#8221;</p>
<p>That defense wouldn’t be much help to him, though, if lawmakers took Dobbs’ own advice and <strong>slapped employers of illegal workers with felony charges</strong>. He has repeatedly called for stiffer penalties on employers who create demand for undocumented workers.</p>
<p>The long hours and low wages involved in the care and grooming of horses are a magnet for illegal immigrants, since most of these jobs won’t be filled by those with other options. According to critics, Dobbs was well aware that landscaping and equestrian care are the kinds of places an employer needs to be vigilant about, and that he could have <strong>required special clauses </strong>in any contract with a third party that employs these kinds of workers. The documents can be written so that the contractor must affirm under penalty of perjury that the workers used are here legally, but in this case they were not.</p>
<p>Although it is unclear how much Dobbs knew about the people working on his grounds and grooming his daughter’s show horse, his biggest enemy could be the trap that affects not only employers like himself, but workers in unskilled jobs across the country. According to <a href="http://www.immigrationlawyers.net/">immigration lawyers</a>, immigrant workers in jobs that are considered low-skilled are in a Catch-22. While there are plenty of jobs in need of unskilled laborers, there are precious few visas for unskilled workers.</p>

			<content:encoded><![CDATA[<p></p><p><a href="http://www.immigrationlawyers.net/wp-content/uploads/2010/10/nationalbank.jpg"><img class="alignleft size-full wp-image-122" title="nationalbank" src="http://www.immigrationlawyers.net/wp-content/uploads/2010/10/nationalbank.jpg" alt="" width="184" height="273" /></a>The Obama administration is proposing a plan to beef up reporting on all electronic money transfers that go into and come out of the U.S. The Treasury Department, whose Financial Crimes Enforcement Network (FinCEN) is responsible for enforcing laws surrounding international money transfers, says that adding this new reporting requirement would improve their ability to track down <strong>sources of terrorist funding</strong>.</p>
<p>Currently, financial institutions must disclose and make available to the Treasury Department information regarding transactions in excess of $3,000. In addition, any <strong>transactions deemed suspicious</strong> by the financial institution must also be disclosed. The new regulation, however, would go beyond simple disclosure to require active reporting of these types of international wire transfers and others, which could make it easier for law enforcement to spot problems before they become tragedies.</p>
<p>&#8220;By establishing a centralized database, this regulatory plan will greatly assist law enforcement in detecting and <strong>ferreting out transnational organized crime, multinational drug cartels, terrorist financing and international tax evasion</strong>,&#8221; said James H. Freis Jr., Director of FinCEN, in a statement.</p>
<p>Fears voiced by privacy advocates echo those that proliferated after the passage of the Patriot Act. According to Marc Rotenberg, Executive Director of the Electronic Privacy Information Center, “These new banking surveillance programs <strong>are testing the boundaries of privacy</strong>.”</p>
<p>The rules are a long-overdue outcome of the 2004 Intelligence Reform and Terrorism Prevention Act, which was intended to <strong>reform the intelligence community</strong> and prevent the conditions that failed to stop the terrorist attacks of 9/11. The law required the Secretary of the Treasury to determine whether such reporting was feasible and reasonably necessary, and if so, to implement the rule.</p>
<p>FinCEN conducted an extensive study of the feasibility of imposing such a requirement. In January of 2007, they published their report; <a href="http://www.fincen.gov/news_room/rp/files/cross_border.html">Feasibility of a Cross-Border Electronic Funds Transfer Reporting System under the Bank Secrecy Act</a>. The report affirmed the feasibility of the beefed-up reporting requirements. The agency then went on to conduct a follow-up study, <a href="http://www.fincen.gov/news_room/rp/rulings/pdf/ImplicationsAndBenefitsOfCBFTR.pdf">Implications and Benefits of Cross-Border Funds Transmittal Reporting</a>, to determine the benefits to the public and the costs to affected parties. After reviewing the published information, FinCEN has determined <strong>the benefits of new reporting rules would outweigh the costs.</strong></p>
<p><a href="http://www.fincen.gov/financial_institutions/msb/amimsb.html">Money Services Businesses</a> (MSBs) that conduct cross-border electronic transmittals of funds will soon be <strong>required to report</strong> international transactions of $1,000 or more. While <a href="../../../../../">immigration lawyers</a> have yet to respond, the public comment period begins this week, with comments accepted up to 90 days after the proposed new rules are published in the Federal Register.</p>

The truth, however, is quite the opposite. America is instead a nation of immigrants, with a long history of people landing on its shores in search of a better life. <a href="../../../../../">Immigration lawyers</a> were not needed until the early 20<sup>th</sup> century, when the first legislation was passed to limit immigration to the U.S.</p>
<p><strong>Early Settlers</strong></p>
<p>From the earliest days of the American colonies, this country has been seen as a land of opportunity. The discovery of the New World opened up vast expanses of land to farmers, trappers, and traders in the 16<sup>th</sup> century, and gave pilgrims a chance to start a new life free from religious persecution.</p>
<p><strong>Mass Migration</strong></p>
<p>Up until the early 19<sup>th</sup> century, the numbers of immigrants, usually from parts of western Europe, were relatively low. Starting in the 1820s, though, a massive wave of migration inundated the United States with approximately 15 million new immigrants. The Industrial Revolution and the inauguration of the Erie Canal in 1825 created new demand for unskilled labor as well as new space in which to settle.</p>
<p>This mass migration spawned the first <a href="http://www.encyclopedia.com/doc/1O119-NativistMovement.html">nativist movement</a> in the United States, as American nationals saw reasons to fear the influx of new immigrants from abroad. The primary concern was over the influence of the Catholic Church and its Irish followers, since the U.S. had largely been a Protestant nation up until that point. Accusations and stereotypes of Irish immigrants were rampant, and some of the racial slurs <a href="http://www.oldnewark.com/memories/newark/mcgrathpaddy.htm">linger in our vocabulary</a> right up to this day, but the newcomers eventually settled down and blended in with the rest of American society.</p>
<p><strong>Give Me Your Tired, Your Poor, Your Huddled Masses Yearning To Breathe Free</strong></p>
<p>The Statue of Liberty was a gift of friendship from France. It was intended to celebrate both nations’ commitment to liberty, and was dedicated on October 28, 1886. The poem which now adorns Lady Liberty’s base was written by the Jewish American poet Emma Lazarus, who saw the statue as a beacon to the world.</p>
